Allied Health Agreements - navigating Contractor and Service agreements

You Legal https://youlegal.com.au recently posted an excellent article/blog post on Allied Health agreement types and I highly recommend anyone who is running a practise read it.


This is one area as a Bookkeeping and Accounting team that we come across every year as a problem area - normally after a business owner has engaged contractors or services agreement staff and then sends us a copy of the agreement so we can understand the GST, BAS and financial implications for Bookkeeping and accounting purposes and on reading it, realise (more often than you think) that someone has used AI to create it, and its missing most of the important bits we need to understand the financial implications of the agreement, or find its been created by copying and pasting information from other different agreements and its at cross purposes (different parts of the agreement clash with each other about the type and operation of the agreement).


One of the most misunderstood areas of contractor agreements and services agreements is around superannuation and if it applies or not with many business owners assuming that if the agreement is an "independent contractor agreement" or a "services agreement" that superannuation would never apply. Here is a sobering thought - as an anecdotal estimation I would say maybe 80 - 90% of all "Independent contractor arrangements/agreements" across our Bookkeeping client base - super APPLIES and is payable to contractors by the business and the business owner has organised us to make sure its calculated and paid
